Colorado Law and Federal Law Apply to Military Divorces
While Colorado state law governs divorce for civilians, military divorces involve federal law as well as Colorado law. The service member will need to determine where to file the divorce case and how the case will proceed if the service member is deployed in another state or overseas.
The federal Uniformed Services Former Spouses Protection Act (“USFSPA”) provides that issues such as child support, spousal maintenance and the division of military retirement pay/pensions are to be governed by applicable state divorce laws.
